THE SERVICES WE OFFER ON OUR WEBSITE, THE ANNOUNCEMENTS THAT WE ARE INTERMEDIATE AND CREATED FOR BOAT OWNERS' BOATS, THE TENANTS GET INFORMATION ABOUT THE BOATS AND MAKE RESERVATIONS THROUGH OUR MEDIA. YOU UNDERSTAND AND AGREE THAT THE SERVICE PROVIDER IS NOT A PARTY TO ANY AGREEMENT BETWEEN BOAT OWNERS AND TENANTS AND THAT THE SERVICE PROVIDER IS THE CHARTER COMPANY, THE BOAT RENTAL AGENCY. YOU DISCLAIMER THAT THE SERVICE PROVIDER DOES NOT HAVE ANY CONTROL OVER THE CONDITIONS AND MOVEMENTS OF BOAT OWNERS, TENANTS AND ANY USER OF THIS SITE OR THE SERVICES AND BOATS AND YOU SHALL HAVE NO LIABILITY IN THIS CONNECTION. 1. DEFINITIONS In this Agreement, the following words and expressions have the following definitions: “Prepayment” means the payment made by the Renter to the Service Provider at the time of Booking. The Advance Payment is a percentage of the Booking Fee and differs from Boat to Boat (determination of this rate is at the sole discretion of the Service Provider or, for some Boats, its designee). “Remaining Payment” means the difference between the Total Boat Price and the Advance Payment, which must be paid by the Renter to the Boat Owner at Check-in. “Agreement” means this Terms of Use Agreement, which is accessed from www.adayachtsailing.com and may be amended from time to time by the Service Provider at its sole discretion and unilaterally. “Boat” refers to the vessels such as sailboats, motor yachts, catamarans or gulets, belonging to the Boat Owner, which have been found suitable for publication on the Site to be reserved by our Company. “Boat Owner” is the legal and rightful owner of a Boat, or has been duly authorized by the legal and rightful owner of a Boat, or has the exclusive and unconditional right to use a Boat. person or persons. Person or persons who own the boat; They are the persons who have given the Adaachtsailing company the right to broadcast, market, and lease their boats for the purpose of making a reservation by a Renter, on www.adayachtsailing.com or on social media sites. “Reservation” means a reservation made by a Renter for a Boat, Adaachtsailing Experience or Advertisement offered by a particular Boat Owner and published on the Site. “Confirmation of Booking” means the formal acceptance of a Booking made by a Charterer with the approval given to us by a Boat Owner. “Reservation Request” means the request made by the Renter for a Reservation prior to this Reservation. “Business Day” or days refers to the days when Turkish banks are open. “Cancellation and Change Conditions” refers to the reservation cancellation and change rules described in our company's contract sample of this contract. “Entry” means the moment when the Boat is delivered to the Renter by the Boat Owner regarding a Reservation Request, whose contract has been prepared and approved by us. “Exit” means the moment when the Boat is delivered by the Charterer to the Boat Owner at the end of the agreed period, with respect to a confirmed Booking Request.

“Entry Date” means the day the Boat is delivered to the Renter by the Boat Owner regarding a Confirmed Booking Request. “Departure Date” means the day on which the Boat is delivered by the Charterer to the Boat Owner at the end of the agreed period for a Confirmed Booking Request. “Reservation Fee” means the fee agreed between the Boat Owner and the Renter for the services included in the price stated by the Boat Owner in our Advertisement. The Service Provider determines the Service Fee it reflects to the Boat Owner over this amount. Some Boat Owners may also include some extra service fees such as fuel fee, cleaning fee, transitlog, captain and crew fees. “Extra Services Fee” is the cost of mandatory and/or optional extra services that are not included in the Booking Fee, such as but not limited to fuel fee, cleaning fee, transitlog, captain and crew fees, which must be paid directly to the Boat Owner by the Renter at Check-in. represents the total.
